General Skilled Migration under the new regulation - 1st September 2007

          The Department of Immigration and Citizenship (DIAC) has examined the current General Skilled Migration (GSM) Program and found that some skilled migrants do not have sufficient English skills required by most Australian employers. Some former overseas students lack relevant work experience leading to difficulty in getting a suitable job. Some are not able to find a job related to their skills and end up working in an unskilled job.

          From 1st September 2007, the regulations has been adjusted to focus more on English skills, work experience, and higher academic qualifications. It is believed that people with proficiency in English, relevant work experience or have higher academic qualifications are more likely to find a suitable employment, adapt to and blend in the Australian community with less difficulty. They are expected to work more efficiently and contribute more to the community.

Basic requirements:

  • Age - Must be under 45 years of age at time of application
  • English - Must have at least sufficient English competency (vocational English) - for working in Australia. A higher level of English may be required for certain occupations where English ability forms part of the skills assessment.
  • Qualifications - Must have post-secondary (such as university or trade) qualifications. Skills must have been assessed by the relevant assessing authority as suitable for the nominated occupation.
  • Nominated Occupation - When applying, applicant must nominate an occupation which fits his/her skills and qualifications. The nominated occupation must be on the Skilled Occupations List (SOL)
  • Recent Work Experience - Applicant must have been in a paid employment in a skilled occupation for at least 12 out of the 24 months immediately before applying.

Recent work experience exemption
An applicant does not need to meet the work experience requirement if he/she meets the ‘2 years study in Australia’ requirement in less than 6 months before lodging his/her visa application.

Point test
General Skilled Migration is mainly based on a point test system.

1. Skill
- For most occupations where training is specific to the occupation, with a Degree or Trade Certificate 60 points
- For more general professional occupations, with at least a Bachelor Degree or higher 50 points
- For other general skilled occupations, with at least a Diploma or higher 40 points

2. Age
18 - 29 30 points
30 - 34 25 points
35 - 39 20 points
40 - 44 15 points

3. English language ability
- At least IELTS 7 in each band 25 points
- At least IELTS 6 in each band for professional/non-trade occupations 15 points
- At least IELTS 5 in each band for trade occupations 15 points

4. Australian work experience
- Applicants with 1 year Australian work experience in the related field or completion of 1 year ‘Professional Year’ study 10 points

5. Specific work experience
- Apply under 60 point occupation and work in related occupations for 3 out of 4 years before applying 10 points
- Apply under an occupation in SOL and work in an occupation in SOL for 3 out of 4 years before applying 5 points

6. Spouse skills
- Your spouse is able to satisfy the basic requirements of age, English language ability, qualifications, nominated occupation and recent work experience and has obtained a suitable skills assessment from the relevant assessing authority for his/her nominated occupation 5 points

7. Occupation in Demand
- If your nominated occupation is on the Migration Occupation in Demand List (MODL) and you have 1 year closely related work experience with no job offer 15 points
- If your nominated occupation is on the Migration Occupation in Demand List (MODL) and you have 1 year closely related work experience with job offer 20 points

8. Australian qualifications
- Applicants with Doctorate Degree 25 points
- Applicants with Bachelor and Master Degree or applicants with Bachelor with/and Second Class Honor 15 points
- Applicants with at least Diploma or Certificate III (trade occupations only) 5 points

9. Regional Australia
- Live and study for at least 2 year in Regional Australia 5 points

10. Bonus Point
- Fluency in one of Australia's community languages (other than English) 5 points

11. Sponsorship
- For provisional visa applicants sponsored by a relative in regional Australia 25 points

12. Nomination
- For visa applicants nominated by a State/Territory government 10 points

* Important: If you nominate one of the above specialist computing occupations, you will only be awarded MODL points if your skills assessment from the relevant Australian assessing body – the Australian Computer Society (ACS) states you have met the criteria to be recognised in one of the above specialisations.

Skills assessments provided to successful applicants will state:

  • the ASCO Code for Computer Professional not elsewhere classified (nec) with the specialisation stated in brackets - for example, 2231-79 (SAP)
    and
  • the statement: 'Based on the provided certified documentation, it is my opinion that the applicant has 12 months experience in (name of specialisation, for example, SAP)'

Note: If you have a skills assessment which only states the ASCO Code for 'Computer Professional nec 2231-79', you are not eligible to be awarded MODL points. A new assessment with the above information will be required if you wish to claim MODL points.
